The Regulations introduce structured eligibility norms. Most notably the regulations stipulate age thresholds, experience requirements, and a five‑year empanelment cycle aimed at enhancing professional standards and accountability.
While the framework reflects global best practices and offers welcome flexibility through discretionary invitations and practice directions, certain drafting ambiguities may hinder consistent application. The authors argue that the long‑term impact of these Regulations will depend on their implementation and the extent to which they promote diversity, accessibility, and the growth of a robust pool of Indian arbitrators. As India’s arbitration landscape continues to evolve, these reforms mark a significant step toward strengthening institutional credibility and global competitiveness.
